‘Shmear For a Year’ Terms & Conditions
This promotion is not a sweepstakes, lottery or contest of any kind. As a condition to participating in this promotion, you hereby agree to the following Terms and Conditions (these “Terms”):
1. SPONSOR. This promotion is sponsored and administrated by Einstein Noah Restaurant Group, Inc. (“Sponsor”), 1720 S Bellaire Street, Skybox Suite, Denver Colorado 80222.
2. PARTICIPATION IN THE PROMOTION. In this promotion, the first fifty (50) eligible participants (as described below) who visit the Einstein Bros. Bagels restaurant located at the addresses and dates listed below during the applicable store’s normal business hours on such date will receive a grand opening gift as described in Section 3 below. Dates subject to change without notice. For purposes of this promotion, an “eligible participant” is an individual who is eighteen (18) years of age or older who has an Einstein Bros. Rewards Program (“Rewards Program”) account in such individual’s name that is in good standing, and who accepts the grand opening gift offered by Sponsor as described in these Terms. NO PURCHASE OR PAYMENT IS NECESSARY TO BE ELIGIBLE TO RECEIVE A GRAND OPENING GIFT IN THIS PROMOTION. Employees, officers and directors of Sponsor and its parents, subsidiaries, affiliates, advertising and promotion agencies, and the immediate families (defined as parents, spouses, children, siblings, grandparents, and their respective spouses) or members of the same household (whether related or not) of each such employee, officer and director, are not eligible to participate in this promotion. This promotional offer is made only in the State of Ohio. Void where prohibited by law.
GRAND OPENING GIFT. A “grand opening gift” consists of and is limited to one (1) award of Einstein Bros. Bagels and Shmear for a Year in the form of one (1) bagel and shmear per week for fifty-two (52) weeks as uploaded by Sponsor to the recipient’s Rewards Program account (award subject to the terms, conditions, limitations and restrictions thereof, including, without limitation as provided in the Rewards Program Terms and Conditions located at https://bagelbrands.com/loyalty-program-terms-and-conditions/). Approximate retail value (“ARV”) of a grand opening gift is two hundred and thirty-five dollars ($235), and the ARV of all grand opening gifts per location is eleven thousand seven hundred and fifty dollars ($11,750). Grand opening gifts must be accepted as awarded. No cash or other substitution may be made, except by Sponsor, who reserves the right (but has no obligation) to substitute a grand opening gift with another gift (including cash) of equal or greater value if a giveaway gift is not available for any reason as determined by Sponsor in its sole discretion. The recipient is fully responsible for any and all applicable federal, state and local taxes and assessments. Acceptance and use of all gifts are subject to all applicable federal, state and local laws, rules and regulations, and these Terms.
4. TERMS AND CONDITIONS. By participating in this promotion, each participant fully and unconditionally agrees to be bound by and accepts these Terms and the decisions of Sponsor (including, without limitation, decisions regarding the awarding of grand opening gifts in this promotion), which are final and binding in all respects.
